Copyright Cutthroats: Movie giant forces pub to fork out big bucks for playing old song
Copyright laws are supposed to provide individuals and companies with restricted rights over their songs, books, movies, etc. This is a good case of a corporation getting overly aggressive. They can't possibly win in court, but they'll threaten a small business owner who can't afford the cost of going to court. This kind of legal bullying should be illegal.

What's So Bad About Making Money Off Fan Fiction?
Being a copyright fanatic actually is bad for business. Writers (of books or songs or whatever) need to realize that allowing fans to create fan fiction gives them free publicity which helps their sales.
A license with just four simple rules can overcome almost all of the problems with allowing fans to monetize their creativity:

ShareAlike—every idea gets shared with the original creator and all the other fans who want to use that idea. This prevents lawsuits and keeps good ideas from being "claimed."

Require fan creators to give credit to the original creator. This drives new fans to the original source so that the creator can share in her fans' prosperity.

Fans should mark their work as being fan-produced by putting [Fanfic] or [Fan Art] after the title or thereabouts. This prevents reader confusion and protects the creator's reputation.

Fans who make more than $100k a year on their activities must pay a 5% cut of the profits to the original creator. This gives creators a share of the wealth if a fan strikes gold, but does not burden casual fan creators with reporting requirements.

The idea is to publish every possible coherent combination of 400 words so that it is impossible for anyone to actually write anything new. That way anything anyone writes will infringe on a previously written passage. Sounds like an impossible scheme? Well, not if you have an army of computers churning out 400 word essays at full speed 24/7! They're trying to do the same with photographs!
What Qentis is proposing is the bulk algorithmic creation of content – music, text, images etc – on such a large scale that in a few years its clients will own the rights to just about anything people might care to create and upload. By 2020, supposedly every possible photograph will have been created and registered by Qentis. Text content generation is advancing at a faster rate.

Users are asked to follow copyright law when posting materials to this message board. Fair use provisions allow for short quotes to be taken from articles. Also embedding videos is permissible. However, lengthy quotes of more than approximately 120 words should not be posted. The exception is when quotes are broken into shorter blocks and meaningful analysis is provided which relates to the posted quotes. (This is sometimes referred to as "value added" in the form of commentary, analysis, criticism, etc.) Safe harbor provisions protect the owner of the message board from prosecution for copyright violations of users, but the owner of this message board wishes to avoid involvement in any possible copyright disputes. So, please follow fair use provisions of copyright law when posting materials to this message board. Also provide a link to any materials referenced in your post whenever possible. Thanks!

Fair Use
Basically it comes down to how much of a work is used and the context in which it is used. As long as you only use a small portion of an article or blog or whatever and you use it in a context in which you are not infringing on the rights of the author to control the work, then you're good. For instance, copying an entire blog or article would be infringing, but posting a paragraph or so is okay as long as you provide some commentary to establish context.
Fair use is a limitation and exception to the exclusive right granted by copyright law to the author of a creative work. In United States copyright law, fair use is a doctrine that permits limited use of copyrighted material without acquiring permission from the rights holders. Examples of fair use include commentary, search engines, criticism, parody, news reporting, research, teaching, library archiving and scholarship. It provides for the legal, unlicensed citation or incorporation of copyrighted material in another author's work under a four-factor balancing test.

Also known as safe harbor. The basic idea is that it is the person who posts the material, not the service provider who is responsible for copyright violations. For instance, Facebook and YouTube aren't responsible for infringing content, but they remove such material when they become aware of it since 1) it's the responsible thing to do, and 2) it keeps them from becoming involved in legal disputes.
The Online Copyright Infringement Liability Limitation Act (OCILLA) is United States federal law that creates a conditional safe harbor for online service providers (OSP) (a group which includes internet service providers (ISP)) and other Internet intermediaries by shielding them for their own acts of direct copyright infringement (when they make unauthorized copies) as well as shielding them from potential secondary liability for the infringing acts of others.

I'm sure half the people who frequent this board are aware of the EFF and something they call copyleft. It has a lot to do with open source and the whole movement to reform copyright law and to make it less restrictive in order to foster increased freedom of expression. At any rate there are a lot of good things going on over at eff.org!

I believe in giving credit where credit is due and I believe in sending traffic to good websites. A snippet from an article is a good way to give the reader an idea of what the article is about and a link to the website is a good way to get the reader to check out the full article. That being said, copyright nazis can be a royal pain in the ass! Moderation in all things or something like that!

I don't think it's necessary to be anal about a limit of 120 words, but much more than that and you have definitely gone too far. I shoot for 90 words or less, but sometimes 90 words just isn't enough!
