cactuspete: Don't know who is calling the shots, whether it's a local person or someone higher up the chain, but negligence and derelection of duty do seem to apply here. Most judges would not put up with such blatant stupidity and although judges tend to be protective of law enforcement this is one of those cases where the decision is so irresponsible and obviously bad that there is no defense!

It's a lot of fun until someone gets hurt. Like wildrose said in the USA 3,232 children have been killed while riding ATVs since 1982. That sends a pretty clear message as far as I'm concerned.

So, I've heard a rumor about an ORV accident out at Great Falls last weekend. The story is that a boy was life-flighted out to Loma Linda. I saw nothing about this in any online newspaper. Are these accidents so commonplace that newspapers don't even bother writing about them. If that's the case then why the hell are children allowed to ride ORVs? We obsess over safety regarding unlikely events and we turn a blind eye to highly probable problems? Are people that stupid?

KissMyTail: It's all about money. Companies that sell motorcycles and quads and all the associated gear make a ton of money. It's very similar to the way tobacco companies operated back in the day. They squelch bad press as best they can and stupid people do stupid things as has always been the case throughout human history. As they say, money talks and victims of ORV accidents might never again walk.... It's called the off-road industy's business model. Get used to it!

Off-Road Vehicle Accidents
Seems to me that lots of accidents are caused due to parental negligence and so parents can be sued. Someone else suggested that the negligence of law enforcement may also be an issue. Sounds like in Trona the negligence of law enforcement is more than just obvious. At some point they make themselves vulnerable to a lawsuit too.
In California City, Gorman, Glamis and throughout the desert, off-road vehicles are extremely popular. Unfortunately, they are also at the heart of many accidents. Adult and child ATV injuries or wrongful death can be caused when an untrained operator collides with another vehicle. Alcohol is often involved in these cases as well, making the negligence clear.

It is quite possible to file a lawsuit against law enforcement if they fail to enforce laws. Sometimes individual officers become a little bit too self-styled and "interpret" laws incorrectly. This can also be a basis for a lawsuit if this creates a situation which leads to unsafe behavior. Given off-road vehicle accident statistics, it's not a good idea for officers to be too loosey-goosey about how they enforce the law. It is their responsibility to ensure public safety and failure to act professionally can land them in court facing a massive lawsuit.
Over 88% of patients were male
Nearly 70% of nonfatal injuries occurred in patients 16 and under
12-15 year olds had the highest rate of nonfatal injury
Nearly 40% of initial diagnoses involved fractures or internal trauma
Nearly 50% of head and neck injuries involved internal head trauma

If local officers took their jobs seriously many injuries could be prevented and perhaps lives saved. Officers who fail to protect the public should be held liable for any accidents which occur which probably would not have happened if they consistently just did their job. Of course, we could probably say the same about parents when it comes to kids who get injured while riding motorcycles or quads.

Teen killed in off-road vehicle accident in Oceano Dunes
Stupid people die doing stupid things. It's hard to feel bad when people engage in dangerous activities and wind up getting themselves killed. It's like they asked for it or maybe they were just suicidal to begin with.
The teen's death marks the sixth fatality at the park this year and comes two days after an Arizona man died in an off-road crash. The California Coastal Commission postponed their decision on future changes to the park until 2020 Thursday.
